Privacy Notice for Business Contacts

This notice is given under Articles 13 and 14 of Regulation (EU) 2016/679 (the GDPR) and Legislative Decree no. 196/2003 (the Italian Privacy Code), as amended by Legislative Decree no. 101/2018.
1. Who we are
GEOUNIQ - S.R.L., Via Palestro 18, 56127 Pisa (PI), Italy, VAT no. and tax code 02421900503, REA PI-347439 (GeoUniq, we), a company of the Cloud4Wi group, is the controller of the personal data described in this notice.

2. Whose data, and which data
This notice applies to the contact persons, signatories and billing contacts of the companies with which GeoUniq has a contract.
We process your name, job title or role, business email address and telephone number, your signature where you sign on behalf of your company, and the communications exchanged with you in the course of the contract. We obtain this data from you or from your company.
3. Why we use it, and on what legal basis
- To conclude, perform and renew the contract with your company, and to communicate with you about it. Legal basis: our legitimate interest in managing the business relationship with your company (Art. 6(1)(f) GDPR); where you are yourself the contracting party, the performance of the contract (Art. 6(1)(b) GDPR).
- To issue invoices, keep accounts and meet our tax obligations. Legal basis: compliance with our legal obligations under Italian tax and accounting law, including Presidential Decree no. 633/1972 (VAT) and Articles 2214 and 2220 of the Italian Civil Code (Art. 6(1)(c) GDPR).
- To establish, exercise or defend legal claims. Legal basis: our legitimate interest in protecting our rights (Art. 6(1)(f) GDPR).
We do not use your data for marketing, we do not profile you and we do not take automated decisions about you. Providing your data is necessary to manage the contract; without it we cannot perform it.
4. Who handles your data
GeoUniq has no staff of its own. The contract is managed on our behalf by Cloud4Wi S.r.l. (Pisa, Italy) and Cloud4Wi Inc. (United States), which act as our processors under Article 28 GDPR. They use business systems such as customer-relationship, accounting and email services, whose providers act as sub-processors.
Where required, we also share your data with our accountants and auditors, the tax authorities, and courts or other public authorities.
5. Transfers outside the European Economic Area
Cloud4Wi Inc. and some of the service providers mentioned above are located in, or can access data from, the United States. These transfers are protected by the Standard Contractual Clauses adopted by the European Commission (Implementing Decision (EU) 2021/914) and, where the recipient is certified, by the EU-U.S. Data Privacy Framework. 6. How long we keep your data
We keep your data for the duration of the contract and then for 10 years, which is the general limitation period under Article 2946 of the Italian Civil Code. Invoices and accounting records are kept for 10 years from the last entry (Article 2220 of the Italian Civil Code). Where data is needed for a pending dispute, we keep it until the dispute is finally resolved.
7. Your rights
You have the right to access your data, to have it corrected or erased, to restrict its processing, and, where applicable, to data portability. To exercise these rights, write to dpo@cloud4wi.com.
Right to object. You can object at any time, on grounds relating to your particular situation, to processing based on our legitimate interest (Art. 21 GDPR). We will then stop that processing unless we demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or we need the data to establish, exercise or defend legal claims.
You also have the right to lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali), Piazza Venezia 11, 00187 Rome, www.garanteprivacy.it, or with the supervisory authority of the EU Member State where you live or work.
8. Changes to this notice
We may update this notice. If we make material changes, we will inform you through the contact channels we use for the contract. The current version is published on the Cloud4Wi website and is available on request at dpo@cloud4wi.com.
